Score issues

Editor has no name, the only file is a scan of an printed score, perhaps with copyright problems. Delete? - Claude 10:59, 5 March 2009 (UTC)

I've just added the contributor's name, according to this page and I've added a link to this page from the composer page. We have allowed scans of printed scores to be hosted on, and indexed in, CPDL before so I don't really see what the problem is here. I can't comment on any copyright problems as I'm not sure what you're referring to, Claude. Could you be more specific? --Bobnotts talk 11:34, 5 March 2009 (UTC)
In fact the score came from this page and the "editor" or creator of this scan was Yu Chao. Dale was just the contributor, as correctly assigned. But Claude is right about his concerns with respect to copyright; the above-mentioned site states at the bottom of the page: "Any distribution or commercial use of these files & examples is absolutely forbidden. Use of these without permission from the authors/owners is an infringement of rights reserved." I would suggest that the file be deleted and replaced by a link to the Bach-cantatas page. —Carlos Email.gif 11:53, 5 March 2009 (UTC)
They may very well like to make those claims, Carlos, but they have no legal grounds for them. I believe I'm correct in thinking that US copyright law recognises only creative input. So simply scanning a score and adding some page numbers and a title is not sufficient to be able to claim copyright of a work which was composed by a great man who died almost 260 years ago!! There is an English translation which may well be copyright, but, I suggest, not by Yu Chao since it was clearly already included in the original publication. This is an excellent example of copyfraud, where someone knowingly or otherwise suggests that they have more IP rights than they do. Rob, you're probably right about their claims; in the history backlog of their site there is this announcement:

But on Yu Chao's site one reads:
"All the files are derived from public domain music in editions that are in the public domain. So you may freely copy, print, distribute the files."

For me it's not a question of *music* copyright but of *printed matter* copyright I don't know if this is a Breitkopf or Peters' book but it may not be more than 50 years old. <Mode serious off> You know, my son, in the whole world of the PDF scores, there are only two kinds : the one is the PDF you generate with your music edition software, with blood and tears. This one comes generally with its MID file attached or its Finale etc file. This one is the good one. The other one, my son, comes alone, it's only a photocopy, you know, copy with photons the work of another man. That is the bad one, my son. <mode serious on>. The only creative work that was made on this score was to put a name on top and to mask the original page numbers at the bottom.
